Privacy policy and information on the processing of personal data

within the meaning of Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the “GDPR”)

Dear Customers,

our company Cresco Real Estate (CRE) a.s., ID No.: 055 41 352, with its registered office at U Uranie 954/18, Holešovice, 170 00 Prague 7, registered in the Commercial Register kept by the Municipal Court in Prague, File No. B 21984 (the “Company”), as the personal data controller responsible for the process of selling properties within the Yards Žižkov project, hereby provides you with information on the processing of any personal data which you may provide to us, in accordance with Article 13 of the GDPR (the “Privacy Policy”). This Privacy Policy contains information on what personal data of yours we process and how we protect it.

General information

The protection of your personal data is our priority and any personal data you may provide to us are always processed only to the extent necessary and for the strictly necessary period of time. Our Company respects all legislation relating to the protection of personal data, in particular the GDPR, and continuously adopts and observes administrative, technical and organisational measures to ensure that your data is secure and that it cannot in any way be leaked or misused.

Personal data processors

Your personal data are processed either directly by the Company or by another company within the Cresco or CRE WOOD group, which likewise provides sufficient and reliable guarantees in terms of technical and organisational security of your personal data:

However, your personal data may also be processed for us by the following processors and recipients, who likewise provide sufficient and reliable guarantees in terms of technical and organisational security of your personal data. In particular, these include:

  • uppliers of construction works within the construction of apartments and houses;
  • IT technology suppliers;
  • substitute suppliers and service providers;
  • banking institutions in the event of mediation of loan financing for the purchase of a property;
  • other persons involved in the conclusion and record-keeping of contracts and related documents;
  • insurance companies;
  • accountants and tax advisors;
  • law firms cooperating with the controller;
  • employees of the controller;
  • the controller’s marketing and real estate consultants;
  • real estate brokers and agents;
  • public authorities and other entities in connection with the exercise of statutory rights and the fulfilment of statutory obligations.

The Company will disclose personal data to third parties only on the condition that such third party concludes with the Company a written personal data processing agreement within the meaning of Article 28 of the GDPR, under which it undertakes to provide at least the same guarantees for the protection and security of personal data as the Company.

Personal data processed

We process only such personal data which you provide to us in connection with the use of our services, the sending of commercial communications and the contracts concluded. We process in particular the following personal data:

  • first name and surname;
  • company name;
  • date of birth;
  • telephone number;
  • e-mail address.

If you have already concluded a contract with us, we usually also process the following personal data:

  • permanent residence address;
  • marital status;
  • bank account number;
  • ID No. (in the case of sole traders);
  • birth number (national ID number);
  • place of birth;
  • ID card number / copy of ID card / copy of health insurance card;
  • citizenship;
  • nationality;
  • information on income (in connection with the performance of AML obligations).

Period of processing

We will process your personal data for the period of:

  • the duration of the business / legal relationship; and
  • for the necessary period after the termination of the business / legal relationship, for the purpose of entering into a new relationship or dealing with the consequences of the termination of the legal relationship,

however, for no longer than 10 years, or until you withdraw your consent. The period of processing is determined with regard to the mutual interests, our duty of professional care and the applicable limitation periods.

Consent to the processing of personal data

You may withdraw your consent to the processing of personal data at any time. However, withdrawal of your consent shall not affect the lawfulness of the processing of your personal data based on such consent prior to its withdrawal. You may withdraw your consent at any time in writing, by sending an e-mail or a letter to the above contact address of our representative, without any additional costs and without any consequences for your existing or future contractual relationships between you and the controller. In such a case, we will cease all processing activities.

Certain personal data which are necessary for the proper performance of a contract are processed, irrespective of your consent, for the strictly necessary period of time (including, for example, the warranty / complaint period provided). This also applies to the fulfilment of obligations arising for us from generally binding legal regulations, where we must process some of your personal data for the period laid down by such legal regulations or in accordance therewith, even after any withdrawal of your consent.

Rights of the data subject and handling of requests

As a data subject, you have in particular the following rights under the GDPR:

  1. the right to withdraw your consent (Article 7(3) of the GDPR);
  2. the right to obtain information as to whether and which personal data concerning you we process (Article 15 of the GDPR);
  3. the right to rectification, i.e. if we process information concerning you which is not true, is inaccurate or out of date, you have the right to request that such information be corrected (Article 16 of the GDPR);
  4. the right to erasure, i.e. if there is no longer any legitimate reason for processing the personal data, you have the right to request the erasure of such data (Article 17 of the GDPR);
  5. the right to restriction of the processing of your personal data in certain cases (Article 18 of the GDPR);
  6. the right to data portability (Article 20 of the GDPR);
  7. the right to object to processing (Article 21 of the GDPR);
  8. the right to lodge a complaint with the Office for Personal Data Protection.

If you exercise your rights under the GDPR with us, we will respond to your request within one month of its receipt; in complex cases or where we receive a larger number of requests, this period may be extended by up to a further two months. In any event, however, we are entitled to request that you verify your identity so that we can be certain that it is not an unauthorised third party requesting access to your personal data.

Other information

We further inform you that no automated decision-making or profiling takes place on the basis of any personal data which you may provide to us, except where you may have given your consent to the use of analytical and advertising cookies.

Your personal data may be transferred, with your full knowledge, to third countries or to an international organisation within the meaning of Article 13(1)(f) of the GDPR only if appropriate safeguards and conditions are in place for the enforceability of your rights as a data subject and for the provision of effective legal protection (in particular on the basis of a decision of the European Commission and standard contractual clauses on the protection of personal data pursuant to Article 46 of the GDPR).

This Privacy Policy may be amended and updated from time to time.
